Workplace health and safety is not only a moral responsibility, but also a legal requirement in South Africa. The Occupational Health and Safety Act 85 of 1993 places a legal duty on employers to provide and maintain a working environment that is safe and without risk to the health and safety of employees.

Under Section 8 and Section 13 of the Act, employers are required to identify workplace hazards, implement precautionary measures, and ensure employees receive the necessary information, instruction, training and supervision to work safely and responsibly.

SECTION 8
2. Implement Precautionary Measures

Employers are required to establish precautionary measures and provide the necessary means to reduce or control workplace risks. These measures help protect employees, prevent incidents and support a safer working environment.

SECTION 8
3. Provide Information, Training & Supervision

The Act requires employers to provide employees with the necessary information, instructions, training and supervision needed to work safely. Employees should understand workplace hazards, safe procedures and the correct use of equipment and machinery.

SECTION 13

Employers must ensure that employees are made aware of the hazards related to their work, equipment, substances and workplace processes, as well as the precautionary measures that should be followed to maintain health and safety in the workplace.
